Give me the primary reasons why we, i.e. our company or group, should hire your law firm.

1. We provide quality workmanship at a level on par with or better than that of our top competitors, yet we are far smaller and the attention given your matter is much more personalized.

2. We provide better pricing than our true competitors.

3. We provide quicker response to problems when they arise. Contact is always made within 24 hours or sooner regarding legal issues transmitted by telephone, fax or otherwise.

4. We utilize an impassioned approach to the resolution of your legal issues.

5. We maintain and promote dedicated tenacity towards achievement of our client’s transactional or litigation goals and/or problems.


What are any possible weaknesses?


1. Perhaps we, as a firm, do not take enough personal time off from our work.

2. On extremely complex issues involving such matters as taking a firm public (and we do not believe this is a negative) we may position ourselves more as a team leader than the out front firm, given the requirements and given our background relative to that type of a proceeding, i.e. a public offering of securities or the like.


Do you take cases on a percentage versus hourly basis?


1. Yes depending on the facts and circumstances and our evaluation of the case. However, we should be quick to note that we take percentage cases primarily in negligence and related tortious cases involving such matters as negligence, wrongful death and certain other related civil wrongs such as emotional distress and the like.

2. Generally, we do not take transactional work on a percentage basis. However, there are certain particular circumstances where a start-up company may want to offer, as part of a fee, a percentage of ownership in the company. This matter must be approached with the utmost caution and assuming that our percentage is going to be something less than a controlling interest and assuming that all parties are aware of the potential for conflicts of interest and waive the same in writing, we have, from time to time participated in those types of matters in that fashion.

3. Most or our civil litigation and business work in the business arena and/or real estate arena or related areas, are performed on an hourly basis and our 2003 rates are: $335 per hour for Steven H. Wilhelm; $125 per hour for paralegal; $60 per hour for word processing; $75 per hour for law clerk research.

4. On occasion, in relation to transaction or litigation, there may be times when a hybrid fee arrangement will be something that will work for both the client and the office. For instance, instead of charging $335 per hour, perhaps the hourly rate would be reduced assuming a percentage of the gross recovery, versus a full contingency where the firm would take a larger percentage of the recovery. Costs in those types of cases are worked out on a case-by-case basis.
